Terms of service

These Terms of Service govern your access to and use of tgme (the "Service"). By registering for or using tgme, you agree to be bound by these terms. If you do not agree, do not use the Service.

1. Acceptance

By creating an account, accessing tgme through any channel, or clicking "I agree," you accept these Terms and any policies referenced within them, including the Acceptable Use Policy and Privacy Policy.

If you are using tgme on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Account & eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create a tgme account. Accounts are per-organisation or per-individual and are not transferable.

You are responsible for: - All activity that occurs under your account - Keeping your credentials confidential - Immediately notifying us of any unauthorised access

We may suspend or terminate accounts that we reasonably believe are in violation of these Terms.

3. Subscriptions, billing, and refunds

Paid plans are billed monthly or annually in advance. All fees are in USD unless otherwise stated. You authorise us to charge your payment method on file at each billing cycle.

Refunds are handled on a case-by-case basis and are generally issued only for verifiable service outages exceeding our stated SLA. Cancellations take effect at the end of the current billing cycle; you retain access to paid features until then.

Annual subscriptions cancelled before the term ends will not receive a pro-rated refund unless required by applicable consumer-protection law.

4. Acceptable use

Your use of tgme is subject to our Acceptable Use Policy, which is incorporated by reference. Prohibited uses include, but are not limited to, unsolicited messaging, phishing, harassment, distribution of malware, and any activity that violates applicable law or the terms of the Telegram platform.

We reserve the right to suspend accounts engaged in prohibited activity without prior notice.

5. Intellectual property

tgme, including its software, design, trademarks, and content authored by us, is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service in accordance with these Terms.

You retain ownership of content you submit to the Service. You grant us a limited licence to store, process, and transmit that content solely as necessary to provide the Service to you.

6. Your content

You are solely responsible for the content you broadcast, publish, or otherwise transmit through tgme. You represent and warrant that you have all rights necessary to use, distribute, and process such content.

We do not review your broadcasts in the ordinary course of business. We may, however, remove content or restrict features to comply with law, respond to abuse reports, or protect the integrity of the Service.

7. Third-party services

tgme integrates with third-party services including but not limited to Telegram Bot API, payment processors (Stripe, ToyyibPay, ePUSDT), and analytics providers. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party service availability, changes, or breaches.

8. Suspension and termination

We may suspend or terminate your account with or without notice if (a) you materially breach these Terms, (b) required by law, or (c) we discontinue the Service. On termination, your right to use the Service ends and we may delete your data after a reasonable retention window.

You may cancel your account at any time from within the dashboard.

9. Disclaimers

The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or free of errors. Delivery of messages depends on the Telegram platform and other factors outside our control.

10. Limitation of liability

To the fullest extent permitted by law, our aggregate liability for any claim arising out of or related to the Service will not exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim or (b) USD 100.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill.

11. Indemnification

You agree to indemnify and hold tgme, its officers, and employees harmless from any claim, damage, or expense (including reasonable legal fees) arising out of your breach of these Terms, your content, or your use of the Service in violation of applicable law.

12. Governing law and disputes

These Terms are governed by the laws of Malaysia, without regard to conflict-of-law provisions. Any dispute arising out of these Terms will be resolved in the courts of Kuala Lumpur, unless applicable consumer-protection law grants you a mandatory alternative forum.

13. Changes to these Terms

We may modify these Terms from time to time. Material changes will be notified in-product or by email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
